General Terms of Sale

1. Subject matter and scope
These General Terms of Sale govern the booking of sea kayak activities offered by Kayak Cabo de Gata (LEIRE GAVELA LOPEZ, VAT 70048871G) through the website kayakcabodegata.es and by any other means (phone, WhatsApp). Making a booking implies full acceptance of these terms.
2. Prices
Per-person prices for our kayak excursions are as follows:

| Children (4 to 10 years) | 20 € | Travel seated in the centre of the kayak between adults, with no need to paddle. |
| Children under 4 years | Not allowed | For safety reasons, children under 4 years old cannot participate in any of our activities. |
Prices include kayak, paddle, approved life jacket, snorkel equipment (mask and snorkel), expert guide, sports activity insurance and experience photos. VAT included in all prices.
3. Booking and payment
Bookings can be made through the online booking system on kayakcabodegata.es (Bokun platform), by phone or by WhatsApp on +34 605 94 71 78.
To confirm the booking you must provide: full name, WhatsApp contact number, number of participants and ages of all participants.
Payment can be made online by credit/debit card through the booking platform, or in cash before the activity begins, paid directly to the guide. Card payment is not accepted at departure points.
4. Departure point
The departure point is determined by the wind.
The afternoon before your excursion you will receive a WhatsApp message with the exact departure point and any relevant information.
Possible departure points are La Fabriquilla or Las Negras (Cabo de Gata, Almería). Both are close to each other. If you do not receive the confirmation WhatsApp, contact us on +34 605 94 71 78.
5. Cancellation policy
Free cancellation up to 24 hours before
If you cancel more than 24 hours in advance, you will receive a full refund of the amount paid.
Late cancellation or no-show
Cancellation less than 24 hours in advance or no-show at the departure point will result in forfeiture of the amount paid as deposit or booking fee.
Cancellation by Kayak Cabo de Gata
If the company cancels the activity due to adverse weather conditions or other force majeure, the client will receive a full refund or the option to reschedule the activity at no additional cost.
6. Weather conditions
The safety of our clients is our top priority. Kayak Cabo de Gata reserves the right to cancel or modify the activity when weather conditions (excessive wind, swell, heavy rain or otherwise) do not allow the activity to be carried out with proper safety guarantees.
In the event of cancellation due to weather conditions, the client may choose between a full refund of the amount paid or rescheduling the activity for a later date, at no additional cost. The company is not liable for travel, accommodation or other costs incurred by the client in connection with the activity.
7. Important information for participants
- Ability to swim is essential for participating in open-sea routes.
- Participants with back, ear, shoulder or other physical conditions that may be aggravated by kayaking assume full personal responsibility for their participation.
- Kayak Cabo de Gata holds current civil liability and accident insurance as required by active tourism company regulations.
- The company is not liable for loss or damage to electronic devices, valuables or personal effects brought on activities.
- Life jacket use is mandatory throughout the activity.
- Mineral or biodegradable sunscreen is required within the Cabo de Gata-Níjar Natural Park.
- Guides may modify the route for safety or weather reasons without this constituting a breach of contract.
8. Applicable law and jurisdiction
These terms are governed by Spanish law. Any dispute arising from the contracting or provision of Kayak Cabo de Gata services shall be submitted to the courts of the consumer's domicile, or, failing that, the courts of Almería (Spain).
